The Anti-Dumping Review Panel (Review Panel) has recommenced a review following orders from the Federal Court of Australia that the:
- ascertainment of the normal value and dumping margin for PMB Aluminium SDN BHD (PMBA) by the Anti-Dumping Commission (ADC) in Report 591 be set aside,
- recommendations of the Anti-Dumping Review Panel (Review Panel) contained in Report 155 be set aside, and Report 155 be quashed,
- decision of the former Minister for Industry and Science (former Minister), made on 14 December 2023 and published on 15 December 2023 be set aside.
The matter was remitted to the ADC for preparation of a report and the making of recommendations on only the normal value and dumping margin for PMBA according to law. Upon the provision of the ADC’s report, the Review Panel is to prepare a report under s 269ZZK of the Customs Act 1901 (the Act) in response to Capral’s application for review dated 12 July 2022.
On 20 February 2026, the ADC provided its report to the Review Panel. A copy of the ADC's report is available here. Accordingly, the Review Panel has recommenced its review of the former Minister’s decision made under s 269ZHG(1) of the Customs Act 1901 (the Act) in respect of aluminium extrusions exported from Malaysia and Vietnam (the Reviewable Decision).
