Dear Minister
Thank you for your letter of 4 September 2025 outlining your expectations for how the Department of Industry, Science and Resources will administer the export permissions for the Kimberley Process Certification Scheme (KPCS) on your behalf.
I recognise the importance of the KPCS, and Australia’s commitment to breaking the link between the trade in rough diamonds and the financing of armed conflicts. In performing this function, I confirm that the department will adhere to the guidance from the Department of Finance, the requirements of the KPCS, as well as remaining compliant with the relevant legislation. This includes adherence to the Best Practice Principles outlined in Resource Management Guide 128 (RMG 128) which are outlined below.
I further recognise the importance of our obligations under legislation such as the Public Governance, Performance and Accountability Act 2013 (PGPA Act), and the expectation for the inclusion of the KPCS in our corporate and annual reporting processes.
Principles
Principle 1
I intend for the department to adopt a whole-of-system perspective as the export authority. This includes a commitment to continuous improvements in our governance, performance and capabilities; and to maintain an organisational culture that supports best practice.
The department will demonstrate its commitment to improved governance through annual reporting mechanisms, both within the department and to the KPCS itself, by including reflections on its performance.
The department will align its approach and implementation with the 6 principles of the Regulatory Policy, Practice and Performance Framework for its role, regulatory posture, specific legislative objectives, functions, and environment.
Principle 2
I intend for the department to manage risks proportionately while performing this export function, to better balance risk mitigation with efficiency, growth and dynamism as a priority. This will ensure essential safeguards are maintained while allowing for regulatory adjustments and innovation to lower barriers to trade when such opportunities are identified.
The department will engage with internal risk management processes, focusing on business continuity in the face of disruptions, and making sure that our systems are future proofed. Where appropriate, the department will engage with the development of broader risk management frameworks and opportunities for improvement, such as enhancements in data and digital technology. These processes will be considered when relevant and with the intention to reduce regulatory burden, foster resilience and improve productivity.
Principle 3
I intend for the department to be transparent and responsive in its communications as the export authority, implementing the relevant regulations in a modern and collaborative way.
The department will continue to be collaborative and responsive to external stakeholders, including agency counterparts in the Department of Foreign Affairs and Trade and the Australian Border Force, potential exporters of rough diamonds, and other participants in the KPCS, with consideration for the global regulatory operating environment. The department will also ensure statistical reporting and recurring audits are submitted to the KPCS in a timely manner.
